Wetland Delineation in New York State – What You Need to Know

If you own property in New York State, new wetland regulations may affect you. Wetland delineation helps determine whether your land contains protected wetlands, which could impact building or development plans.

What is Wetland Delineation?

Wetland delineation is the process of identifying and mapping the boundaries of wetlands on your property. It ensures compliance with state laws and helps you avoid fines or project delays. The process can take up to 90 days from submission of the delineation request.

What’s Changing?

As of January 1, 2025, the New York State Department of Environmental Conservation (NYSDEC) has expanded its wetland protections under revised freshwater wetlands regulations (6 NYCRR Part 664):

More wetlands are now regulated, even if they were not previously mapped.

Wetlands of “Unusual Importance” are protected, regardless of their size.

An estimated one million more acres of wetlands will now require permits for development.

Property owners can no longer rely on NYS Freshwater Wetlands Maps to determine if their land is regulated. Instead, they must request a determination from NYSDEC.

How Wetland Delineation Works

If you think you may have wetlands on your property, here’s what to do:

1. Preliminary Assessment – Use NYSDEC’s Environmental Resource Mapper to check if your land is in a potential wetland area.

2. Field Inspection – A wetland expert will visit your property to look at soil, vegetation, and water levels to determine if wetlands are present.

3. Mapping & Reporting – The expert will map out the wetland boundaries and prepare a report for submission.

4. Jurisdictional Determination – Submit the report to NYSDEC, which will officially confirm if your wetlands are protected under the new law.
